Terms & Conditions

These Terms and Conditions (together with the End User Licence they contain, the “Terms”) are an agreement between you and Horizon Network Pty Ltd as trustee for The Scene Group Trust (ABN 17 755 719 604), trading as Lucky! (“Lucky!”, “we”, “us”, “our”), for the Lucky! mobile game (the “Game”).

1. Acceptance

By downloading, installing or playing the Game you agree to these Terms. If you do not agree, do not use the Game. This agreement is between you and us; Apple is not a party to it (see Section 10).

2. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Game for your personal, non-commercial entertainment, subject to these Terms and the App Store rules.

3. Eligibility

The Game contains simulated gambling and is rated 17+. You must be at least 17 years old to play, and at least 18 (or the age of majority where you live) to make in-app purchases unless the account holder has authorised you to use the payment method. If you are under 18, a parent or guardian must have agreed to these Terms on your behalf.

4. Lucky Coins and virtual items

4.1 The Game uses a virtual currency called Lucky Coins and offers virtual items such as dice skins (together, “Virtual Goods”). You can earn Lucky Coins by playing, through daily bonuses and optional rewarded videos, or buy them in packs through Apple’s in-app purchase system.

4.2 Virtual Goods have no monetary value. They are a limited licence to use a digital feature inside the Game. They cannot be redeemed, cashed out, sold, transferred or exchanged for real money or anything of value outside the Game. Winning a match wins Lucky Coins only.

4.3 Staked tables charge a coin buy-in. The winner receives the pot less a 10% house commission in Lucky Coins. This is a game mechanic, not a fee you pay us in money.

4.4 We may adjust, rebalance, add or retire Virtual Goods, coin values, bonuses and table stakes. Your licence to Virtual Goods ends if your access ends or the Game is discontinued, except where the law requires otherwise.

No real-money gambling. Lucky! is a game of entertainment. Nothing you buy or win in the Game can be converted into money. If you feel your play is becoming a problem, help is available in Australia from Gambling Help Online on 1800 858 858.

5. Purchases and refunds

5.1 All purchases are made through Apple and are subject to Apple’s terms. Prices are shown in the App Store in your local currency and, for Australian users, include GST where applicable. We do not see your payment details.

5.2 The Game offers consumable coin packs; a one-time Starter Pack (15,000 Lucky Coins, the Velvet dice and 24 hours without ads between games); a one-off No Ads purchase, which stops ads between games; and the Salon Privé membership described in 5.3. Optional rewarded videos remain available to everyone.

5.3 Salon Privé is an auto-renewing subscription, billed monthly (A$7.99) or yearly (A$59.99), or the equivalent price shown in the App Store where you live. The monthly plan includes a 3-day free trial for eligible new subscribers; any unused part of a trial ends when you subscribe. Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically at the same price for the same period unless you cancel it at least 24 hours before the current period ends. You can manage or cancel it in your Apple Account settings (Settings → [your name] → Subscriptions). While it is active you get no ads between games, a daily stipend of 500 Lucky Coins, a doubled daily bonus, the members’ Salon dice and the gold avatar ring; these benefits stop when the subscription ends.

5.4 Use Restore Purchases in the Game to recover No Ads and an active Salon Privé membership on a new device. Consumable coins and the Starter Pack are delivered once and are not restorable by design.

5.5 Refunds for App Store purchases are handled by Apple under its policies. Nothing in these Terms limits your rights under the Australian Consumer Law, including remedies where a product is faulty or not as described.

6. Fair play and acceptable use

You must not: cheat, use bots, scripts, modified clients or exploits; tamper with coin balances or match data; reverse-engineer or modify the Game; harass other players, including through in-match chat; disrupt the service; or use the Game unlawfully. We may reset balances, suspend or end your access for breach, and we are not obliged to compensate Virtual Goods lost as a result.

7. Online play

Online matches use Apple Game Center. The display name and avatar you choose are shown to the other players at your table. Voice chat and text chat are available only when everyone at the table is one of your Game Center friends. If Screen Time limits communication on your device, other players see only your Game Center name and an in-game crest, and voice and chat stay off. You are responsible for your Game Center account and for the name, avatar and messages you share. We do not control other players’ conduct; to report abuse, email lucky.support@horizonnet.work with the player’s Game Center name and the time of the match.

8. Availability and changes

We may update, change or withdraw features, run maintenance, or discontinue the Game. We try to give reasonable notice of major changes but cannot always do so. The Game needs an internet connection for online play, purchases and ads.

9. Intellectual property

The Game, its characters, story, artwork, music, sounds, code and names are owned by or licensed to us. These Terms give you no rights except the licence in Section 2. Feedback you send us may be used without any obligation to you.

10. Apple terms

These Terms incorporate Apple’s standard Licensed Application End User Licence Agreement. You acknowledge that: the licence is granted by us, not Apple; Apple has no obligation to provide maintenance or support for the Game; to the extent permitted by law Apple has no warranty obligation and is not responsible for any claim relating to the Game; you will comply with applicable third-party terms when using the Game; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Your rights under the Australian Consumer Law

Our digital products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies those guarantees or the remedies available for their breach.

12. Liability

Subject to Section 11 and to the extent permitted by law, the Game is provided “as is”. We are not liable for indirect or consequential loss, for lost progress or Virtual Goods, or for loss arising from events outside our reasonable control, including outages of Apple or Google services.

13. Privacy

We handle personal information under our Privacy Policy and the Privacy Act 1988 (Cth).

14. Termination

We may suspend or end your access for breach of these Terms. You may stop using the Game at any time by deleting it. Sections that by their nature should survive (intellectual property, liability, Virtual Goods having no value) continue after termination.

15. Governing law

These Terms are governed by the laws of Western Australia, and you submit to the non-exclusive jurisdiction of its courts. Nothing in this clause limits consumer rights that apply where you live.
